Users of this site hereby agree to be bound by all of these terms and conditions, which are subject to change at Mobile Video Game’s sole discretion. Your use of and access to this site indicates your acceptance of these Terms & Conditions, as they exist at that time.

Users will not use this site for any purpose or in any way which is unlawful.
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of New South Wales.


Disclaimers

Photosensitive seizures
A very small percentage of people may experience a seizure when exposed to certain visual images, including flashing lights or patterns that may appear in video games. Even people who have no history of seizures or epilepsy may have an undiagnosed condition that can cause these “photosensitive epileptic seizures” while watching video games.

These seizures may have a variety of symptoms, including light-headedness, altered vision, eye or face twitching, jerking or shaking of arms or legs, disorientation, confusion, or momentary loss of awareness. Seizures may also cause loss of consciousness or convulsions that can lead to injury from falling down or striking nearby objects.

Immediately stop playing and consult a doctor if you experience any of these symptoms. Parents should watch for or ask their children about the above symptoms—children and teenagers are more likely than adults to experience seizures.

If you or any of your relatives have a history of seizures or epilepsy, consult a doctor before playing.


Liability and Indemnity

Mobile Video Games, its associated entities, and its employees accept no responsibility for any damage to any property or injuries to any persons sustained at or during an event. All liability is the sole responsibility of the customer/persons making a booking with Mobile Video Games.

We reserve the right to recover any costs associated from the customer to repair any acts of wilful or careless damage to our vehicles, trailer, or equipment, as well as the replacement costs of any equipment lost or missing at an event.

Mobile Video Games in itself doesn’t exclude any respect of goods and services under the ACL—Australian Consumer Law—nor its remedies in the Competition and Consumer Act 2010. These rights cannot be ignored, restricted, or changed. Though Mobile Video Games does not include all the rights, remedies, warranty, guarantee, or conditions as far as the respect of goods or services from an individual’s use of the website whether statute-based, local law, or in any case lawfully permitted, and subject to Mobile Video Games’ liabilities and obligations under the ACL:

(a) Mobile Video Games does not in any way give warranty to the content’s accuracy which you access through this website. The content is provided on an “as is” and “as available” basis, and the responsibility for its accuracy remains solely with you.

(b) No one will be held liable for Mobile Video Games concerning loss or damage that may be incurred by you on your application software or hardware from your usage of this website.

(c) Mobile Video Games does not guarantee that the functioning of this website or its content, including hyperlinks, will be uninterrupted or error-free, or that defects will be corrected or the server is free of malicious programs, bugs, or viruses.

(d) You indemnify Mobile Video Games and its associated firms, directors, officials, employees, and authorized agents against any claims, losses, or expenses arising from the use of this site.


Party Location and Approvals

The person or entity hosting the party (the “party holder”) is solely responsible for selecting the location of the event and for obtaining all necessary permits, licences, approvals, consents, or authorisations required by law or any relevant authority. Mobile Video Games accepts no liability for any failure by the party holder to obtain such approvals or for any legal, financial, or other consequences arising from the chosen location.


Intellectual Property

All intellectual property in relation to content on this Site belongs to Mobile Video Games or its licensors, advertisers, or affiliates. You obtain no interest in that intellectual property. All content on this Site is protected by Australian and international copyright and other intellectual property laws. You may not do anything which interferes with or breaches those laws or the intellectual property rights in the content.

All content and material on this Site is for personal, non-commercial use only. Do not modify the content in any way (including any copyright notice). All rights not expressly granted under these terms of use are reserved by Mobile Video Games. Unless expressly stated otherwise, you are not permitted to copy or republish anything you find on the Site without the copyright or trademark owner’s permission.

The logos of the Site are trademarks of Mobile Video Games or its related bodies corporate. Other trademarks may be displayed on the Site from time to time. These may belong to third parties. Nothing displayed on the Site should be construed as granting any licence or right of use of any logo, trademark, or masthead displayed on the Site, without the express written permission of the relevant owner.


Cancellation Policy

No refunds will be given for cancellations.


Food, Drink, Alcohol, and Drugs

Mobile Video Games does not allow the consumption of food or drinks in our trailers or vehicles. Guests may be asked to wash their hands prior to using our equipment to avoid damage.

Drugs of any sort will not be tolerated in or around our trailer or vehicles. Mobile Video Games reserves the right to terminate the event immediately at the cost of the customer if drug use is observed.

Mobile Video Games reserves the right to cancel or cut short any event where alcohol is being consumed. This will be at Mobile Video Games’ sole discretion.


Ratings

It is the responsibility of the parent and/or guardian hosting the party to ensure the games chosen for the event are appropriate for the age group attending. The parent/guardian is also responsible for ensuring that other parents/guardians of attendees are aware of the game ratings and that adequate adult/parental supervision is provided.
